ZOVAN
Terms of Service
Effective: September 29, 2026
1. Acceptance of These Terms
These Terms of Service govern your access to and use of ZOVAN, including its applications, websites, athlete profiles, athlete websites, and related services.
By creating an account, accessing ZOVAN, or using the service, you agree to these Terms and acknowledge the ZOVAN Privacy Policy. If you do not agree, do not use the service.
2. Adult Accounts and Athlete Profiles
ZOVAN accounts are intended to be created and managed by adults. By creating or managing a profile for a minor athlete, you represent that you are the athlete's parent, legal guardian, or another adult authorized to provide and manage that athlete's information.
You are responsible for the accuracy of information you submit and for ensuring that you have the rights and permissions necessary to provide photographs, videos, personal information, statistics, memories, and other content relating to an athlete.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. You agree to provide accurate account information and to notify ZOVAN if you believe your account has been accessed without authorization.
4. Athlete Content and Your Rights
You retain ownership of photographs, videos, text, memories, and other content you submit to ZOVAN to the extent you own rights in that content.
You grant ZOVAN a limited license to host, store, process, reproduce, display, and otherwise use that content as reasonably necessary to operate, secure, maintain, and provide the features of ZOVAN that you request.
This license does not transfer ownership of your content to ZOVAN.
5. Public Athlete Websites
ZOVAN may allow you to publish a shareable athlete website. Information and content you choose to publish through a public athlete website may be accessible to anyone who can access that website.
You are responsible for deciding what athlete information and content is appropriate to make public. Do not publish sensitive information or other content that you do not want publicly accessible.
You represent that you have the authority and necessary rights to make the selected athlete information and content publicly available.
6. Family and Shared Access
ZOVAN may allow you to invite another person to access or help manage an athlete profile. You are responsible for inviting only people who are authorized to access the athlete's information.
Access granted to another person may allow that person to view or modify information associated with the athlete depending on the permissions provided by ZOVAN.
7. Acceptable Use
You may not use ZOVAN to violate the law, infringe another person's rights, impersonate another person, gain unauthorized access to accounts or systems, distribute malicious software, interfere with operation of the service, or upload content that you do not have the right to use.
You may not attempt to bypass security controls, abuse the service, scrape or systematically extract information from ZOVAN without authorization, or use the service in a manner that could harm ZOVAN, its users, or athletes whose information is maintained through the service.
8. ZOVAN+ and Paid Services
Certain features may be offered through ZOVAN+ or another paid plan. Pricing, billing frequency, trial periods, promotional benefits, and other subscription details will be presented when you subscribe.
Unless otherwise stated at the time of purchase, subscriptions may automatically renew until canceled. You may cancel through the subscription management tools made available by ZOVAN. Cancellation generally prevents future renewal and does not necessarily terminate access before the end of an already paid or otherwise active subscription period.
Payment processing may be provided by a third-party payment provider and may also be subject to that provider's terms and policies.
9. Founding Beta and Promotional Benefits
ZOVAN may offer private beta programs, Founding Family programs, trials, discounts, complimentary access, or other promotional benefits subject to eligibility requirements communicated for the applicable program.
Beta features may change, contain errors, or be modified or discontinued as the product develops. Participation in a beta program does not guarantee that every beta feature will remain available in the final service.
Any specific Founding Family or promotional benefit is governed by the terms communicated with that offer, including applicable qualification, duration, continued eligibility, and billing conditions.
10. Service Availability and Changes
We work to provide a reliable service, but ZOVAN may occasionally be unavailable because of maintenance, technical problems, updates, third-party services, or circumstances outside our control.
We may add, modify, or discontinue features as ZOVAN develops. Where reasonably appropriate, we will provide notice of changes that materially affect paid services or user rights.
11. Suspension and Termination
You may stop using ZOVAN at any time and may use available account deletion tools or contact us regarding account deletion.
We may restrict, suspend, or terminate access when reasonably necessary to protect ZOVAN or its users, address misuse or security concerns, comply with law, or respond to a material violation of these Terms.
12. ZOVAN Intellectual Property
ZOVAN and its software, design, branding, logos, interfaces, features, and other materials provided by ZOVAN are owned by ZOVAN or its licensors and are protected by applicable intellectual property laws.
These Terms do not grant you ownership of ZOVAN or permission to use ZOVAN branding except as necessary to use or identify the service.
13. Disclaimer
To the extent permitted by law, ZOVAN is provided on an "as is" and "as available" basis. We do not guarantee that the service will always be uninterrupted, error-free, or that user-entered statistics, schedules, or other information will always be complete or accurate.
ZOVAN is a tool for documenting and sharing an athlete's journey. It is not a substitute for official team, league, school, medical, recruiting, eligibility, or statistical records.
14. Limitation of Liability
To the maximum extent permitted by applicable law, ZOVAN will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
15. Changes to These Terms
We may update these Terms as ZOVAN develops or as legal, operational, or business requirements change. When appropriate, we will update the effective date and provide additional notice of material changes.
16. Governing Law
These Terms are governed by the laws applicable to the provider of ZOVAN, without regard to conflict-of-law principles, except where applicable law requires otherwise.
